BUYER AGREES: All puppies are sold as pet quality, there are no guarantees, expressed or implied, as to adult size of puppy, show potential, temperament, or breeding soundness. Breeding rights are an additional fee and determined by the Breeder. The puppy has been dewormed prior to sale and has received age-appropriate vaccinations. Record of vaccinations will be sent with the puppy. WE STRONGLY RECOMMEND THAT PUPPIES BE RESTRICTED FROM PUBLIC OUTDOOR AREAS AND EXPOSURE TO OTHER DOGS UNTIL THEIR VACCINATION SERIES IS COMPLETED AT 16 WEEKS OF AGE. *In case of death of the puppy before the required initial exam, the Buyer must submit a veterinarian’s necropsy report as to the cause of death and death must be entirely due to a covered congenital defect. Breeder shall be notified immediately in the event puppy has an illness or does not eat well before the initial vet exam. Failure to have the initial vet check done within two days or to notify breeder of illness or poor eating before the initial exam will void this warranty. Breeder shall not reimburse any veterinary expenses or other expenses incurred by the buyer at any time. Breeder’s warranty is limited to a replacement puppy, upon the receipt of (within 2 calendar days of veterinarian’s necropsy report) of the puppy and a written veterinarian’s statement that includes the complete diagnosis of the congenital life-threatening defect that resulted in death of puppy. *Buyer is to arrange a puppy check up by a qualified veterinarian WITHIN 48 HOURS of receiving puppy (not including Sundays). Seller will not be responsible for the health of the puppy after the puppy’s well status has been established at the initial well puppy check. During this initial exam, should the veterinarian detect any life-threatening health condition, you must contact the seller immediately. In the event your vet diagnoses a life-threatening genetic defect at the initial exam, you must return the puppy and all papers (registration, pet guarantee, shot record) to the Breeder. *Treatable and common conditions for animals, including puppies, are the responsibility of the buyer. Not covered conditions include: – internal or external parasites, hernia, undescended testicles, under or overbite, dental malalignment, injury, allergies, heat exhaustion, hip dysplasia, or hypoglycemia. Hypoglycemia is preventable with good care and feeding. *If your puppy is diagnosed with a life-threatening congenital defect making puppy unsuitable as a pet before 1 year from date of birth, it will be replaced with another puppy of the breeder’s choice. This health guarantee is extended to 2 years if the buyer provides proof of spay/neuter procedure at appropriate age for the breed, as well as, documentation of vaccination records being up to date. This health guarantee is void if buyer fails to provide documentation to Peppers Ferry Pups. If puppy is found to have any life-threatening genetic defect, you must notify us immediately and supply us, within 2 days of diagnosis, with your veterinarian’s written report. We reserve the right to have the diagnosis verified by another veterinarian of our choice and/or require the Buyer to have specific tests run on the puppy to verify the diagnosis before exchange. *When the puppy is replaced, it will be replaced with one of equal or lesser value as soon as available, after the puppy and all papers have been returned to breeder. Replacement puppy selection is the sole discretion of Peppers Ferry Pups. Buyer is responsible for all transportation to return puppy. Puppy must not be euthanized without prior written approval from the breeder or this guarantee shall be void. *This puppy is not being bought for resale and shall be maintained and kept under personal control of the Buyer of the puppy, and shall be given adequate housing, food, veterinarian care, and shall in no manner be mistreated, neglected, or allowed to roam freely. This puppy is to be kept as a house dog. This puppy is sold as pet quality. This contract is breeched by Buyer if puppy is bred intentionally or accidentally, unless breeding rights have been purchased at the time of signing contract. Buyer acknowledges that should contract breech occur, Buyer is responsible for all legal fees and court costs of Breeder to pursue proper financial compensation for failure of Buyer to uphold contract. Additionally, Buyer acknowledges the standard breeding penalty fee is $10,000 per litter or $1000 per puppy born to litter. The same standard breeding penalty fee applies to males being used as a stud to create litters. This breeding penalty fee is waived if the breeding rights fee has been paid at the time this agreement is signed by buyer. Unless otherwise granted, Breeder encourages responsible pet ownership of puppy by having puppy being spayed/neutered at the age-appropriate time for puppy’s specific breed. *Puppy is due to be picked up at 8 weeks by Buyer. Any delay in picking up puppy must be approved beforehand by Breeder. If Breeder agrees to keep puppy for any additional time: boarding fees, veterinarian fees, and training fees apply to balance. These fees are as follows: 100/week boarding/training/feeding fee; 50 veterinarian fee for second round of vaccinations, if applicable. Peppers Ferry Pups will continue to provide consistent care, diet, and training of puppy. Peppers Ferry Pups will not be held liable for any injury or accident sustained while in our boarding care. Peppers Ferry Pups has owner's permission to seek Emergency Care, at buyer's expense, if necessary. Delivery fees for Peppers Ferry Pups is 50/hr (travel within a 2hr radius of our location is at no additional cost), and will be added to final balance if it applies. If shipping has been approved by Breeder, arrangements will be made between Breeder and Buyer. Puppy becomes the sole responsibility of the Buyer once the breeder delivers the puppy to transport personnel and puppy is in their care. *If circumstances become so that the Buyer cannot keep this dog, Buyer promises not to discard the dog at any shelter, humane society, or rescue group, and to make every effort to place the dog in another suitable home. If the buyer is unable to provide a suitable home for the dog, the dog shall be returned to the breeder. *Buyer agrees by signing below that under no circumstances will payment be stopped on any check, money order, cashier’s check, or electronic payments which breeder has accepted for payment of VIP membership fee, service fee, reservation fee, or purchase fees. There will be no refunds: no refunds of membership fees; no refunds of total purchase price; no refunds on breeding rights; no refunds of delivery fees, boarding fees, or additional vet visit fees. Initial reservation/VIP membership fees are non-transferable. This written agreement is a binding contract and is the only agreement between the Buyer and Breeder. Contract is to be interpreted pursuant to the laws of Virginia. Jurisdiction and venue to determine disputes shall be in Wythe County. Any dispute regarding this agreement shall be brought solely in Wythe County, Virginia. All legal issues and/or court action will be filed in Wythe County, Virginia.
